Abstract

The ECJ Judgment, Intercontainer Interfrigo (C-133/08) of October 6, 2009 rule on one of the most controversial provision of the Rome Convention on the law applicable to contractual obligations: article 4, -designed to set the law governing the contract in the absence of choice by the parties-. Both the scholarship and the courts of different Members States hold contradictory points of views around the interpretation of article 4. This paper tries to explain each of the questions raised about this provision in order to determine the real impact, it could be reach in Rome I Regulation.
