Abstract

Once more, the ECJ has ruled on European citizenship and again it did it by expanding its originating horizons. This time, by amplifying de facto the right of abode given by the statute to a community citizen to apply to a national of a third party State, on the basis of being the parent of the former and guarantor of the effectiveness of his rights as a citizen of the Union. And this with a new legal basis in the jurisprudence of the ECJ: the rights of citizenship of the Union raised to the category of fundamental as a result of the Charter.
