Abstract

In recent years there has been an increase in the number of cases of squatting in Spain. This paper analyses from a global approach the reasons that may have caused this increase, as well as the existing regulatory failures that may be acting as an incentive to the production of this phenomenon. All the aspects involved in the problem are addressed from a civil, criminal, procedural and constitutional perspective, without forgetting the role of international treaties in relation to the rights involved in this problem: the right to housing, the right to private property and the right to the inviolability of the home. The work concludes with proposals for a solution to this transcendental problem.
