Abstract

The paper deals with the Council Regulation (EC) n. 4/2009 of 18 December 2008 on jurisdiction, applicable law, recognition and enforcement of decisions and cooperation in matters relating to maintenance obligations. The objective of this research is to analyse from two point of view the content and the role of the regulation n. 4/2009. The first point of view is referred to the coordination with the Hague Convention of 2007 on of International Recovery of Child Support and other Forms of Family Maintenance and with the Hague Protocol of 2007 on the Law Applicable to maintenance Obligations. In the framework of the Hague Conference on Private International Law, in fact, the Community ands its Member States took part in negotiations which led to the adoption on 23 November 2007 of the Convention and the Protocol, then ratified by European Union. The second point of view involves the role of the Regulation n. 4/2009 in the framework of the European judicial cooperation in civil matters.
