Abstract

International litigation in the field of divorce and legal separation is now very numerous. Council Regulation 1259/2010 of 20 December 2010 (EU) contains a system of conflict rules that indicate the specific State Law applicable to divorce and legal separation in international cases. In the absence of choice of law by the parties, art. 8 of Council Regulation 1259/2010 includes a number of connectiong factors which determine the applicable law. This paper analyzes the economic logic of such solutions and shows that the EU legislator is successful with these connections. The accuracy of the law applicable to divorce and legal separation has been carried out with regard to the interests of the spouses. Hence, international divorce or legal separation process implies reduced costs for litigants. Therefore, free movement of persons in the EU is enhanced.
