Abstract

The Proposal known as Rome III Regulation presented by the Commission of the European Community on July the 17th 2006 deals with two kind of problems. Firstly, the Proposal tries to overcome the shortcomings arose by Council Regulation 2201/2003 of November the 27th. Secondly, the Proposal creates a brand new body of Conflict-Of-Laws rules in order to determine the Law applicable to divorce and legal separation. These uniform Conflict-Of-Laws rules will avoid the problem of Forum Shopping in the EU. The Proposal contains different connecting factors, in particular, party autonomy, habitual residence, common nationality and Lex Fori ordered in a classical Kegels Ladder system. By these connecting factors divorce should be easier and faster in the European Community and it will also facilitate the recognition of divorce and separation judgments n the EU.
