Abstract

The international trade of diamonds has been subjected to a new regulation with the aim of protecting the market from the inclusion of diamonds of conflict. It operates throw the certification system of the Kimberley Process (KP), provided by the European Union in the Regulation nº 2368/2002 of 20 December. This regulation entails a clear limitation of the free trade principle at a world level that is justified by the intention of breaking the relationship between diamonds trade, armed conflicts and violation of human rights recognized by the United Nations (Resolution 55/56, 2000). There are many difficulties in implementing this pioneering system observing the international trade law principles. Nonetheless, the importance of the creation of a safe legal frame protecting the legal market of diamonds would recommend its adoption in the international trade of other problematic raw materials, specially the coltan.
