Law applicable to the formal and substantive validity of the declaration concerning the waiver of succession in the Regulation 650/2012

Abstract

The judgment of the Court of Justice of the European Union of 2 June 2022 in Case C-617/20 concerns the validity of the declaration concerning the waiver of succession made before the court of the Member State in which that heir has his or her habitual residence. This request for preliminary ruling concerns the interpretation of Articles 13 and 28 of Regulation (EU) No 650/2012. The debate focuses on whether, in order to be considered valid, the communication of the declaration made in the Member State of the declarant’s residence, in accordance with the requirements of the law of that place must, it is necessary comply with the formal requirements laid down in the law of the succession, within the meaning of Recital 32 of Regulation.
