A further step towards the international effectiveness of the judicial sale of ships

Abstract

On December 7, 2022, the General Assembly of the United Nations Commission on International Trade Law (UNCITRAL) adopted the so-called Beijing Convention on the Judicial Sale of Ships, where it was signed on September 5, 2023. The new convention represents a step forward in the recognition of the international effects of judicial sales of ships. For its correct application, the convention will have to be applied in a manner consistent with both national legislation and other conventions that also deal with this matter. This article explores the relationship between these regulatory levels based on the Spanish regulation, between which there is a high degree of compatibility, without prejudice to the fact that some reforms will also be necessary.
