Abstract

Ad hoc commissions designated in accordance with article 41.4 of the ET have been empowered to negotiate in processes of productive reorganisation and “non-application or opt-out clauses” in companies without workers’ representatives. Bearing the announcement of a reform of the ET in mind, the study focuses on the problematic negotiation by the “assembly” commission and puts forward some ideas for the reformulation of its composition. In addition, this work analyses the legal nature of the regime regarding the composition of ad hoc commissions, considering the possibility that workers are represented not by one of the two legal commissions but, as it is happening in practice, by all the workers of the company.
