Notas sobre la colisión de fuentes de Derecho internacional privado español sobre responsabilidad parental y protección del niño
Abstract
The ratification by Spain of the Hague Convention of 1996 on the protection of children (the EU authorized the ratification to the Member States) raises some problems of compatibility with EU Rules on parental responsibility (Brussels II Regulation) so as with the Spanish laws governing the aspects of Private International Law. It would be advisable that the EU reassess its decision to incorporate legal sources with a great complexity that opens some questions about the consistency of its own system.
