Abstract

Spain has decided to accept the United Nations Convention on te jurisdictional immunity of States and their property. Although this treaty is not yet in force, it has already become the legal international reference in both jurisdictional and enforcement immunities.

This Convention embraces a restrictive approach to immunity and, therefore, provide for a wide list of proceedings in which State immunity cannot be invoked.

The United Nations Convention seek to represent the universal juridical nframework on the immunity of  States. However, the Convention does not include the treatement of a actual and important subject: the relationship between the sovereign immunity and the international ius cogens.
