Social “deviation” and legal culture: A look from the social regulation perspective
Abstract
This short text tries to develop a critical analysis about the concept of social deviation. Even when this concept shows a long presence in social sciences and its use in juridical sciences is equally abundant and apparently useful, the ideological charge that usually underlies the idea of social “deviation” makes it very dangerous when we talk about the consequences of the application of any normative that can appear under its guidance. The work tries to show, in the social regulation perspective, the warning that can be done about this matter, in order to avoiding bad uses –for human beings emerging from an incorrect legal application or normative production.
