Migration (in the jurisprudence of the Inter-American Court of Human Rights)
Abstract
The analysis of the jurisprudence of the Inter-American Court of Human Rights relating to the situation of the no nationals helps to develop the particular elements for the analysis of the human right’s violations in migration contexts. Migrant’s vulnerability conditions when living in a foreign country have gradually increased the sensitivity regarding the protection of migrant persons on the part of the Inter-American System’s institutions. An incipient concern about the rights violations when a national is compelled to migrate when her state infringes her rights is also gaining importance in the Inter-American System and in the Inter-American Court’s jurisprudence. Nevertheless, the Court should continue to develop and consolidate the analysis of the conditions of vulnerability in cases of human right’s violations of migrant persons.
