The intersexuality in the medical-legal discourse

Abstract

The paradigm of Western sexual rationality is based on the dichotomies male-female, men-women, normal-abnormal, healthy-unhealthy, moral-immoral, legal-illegal. The democratic West has built a sexual dispositive where the abnormal must be corrected by the surgery and the legal. The birth of an intersexual baby represent a case of neonatal psychosocial emergency, consequently sexual normalization surgery is imposing. In this paper it is understood that we have a case of a genital mutilation consented by society, law and medicine that allows immunize the duality of sexes. A kind of violence imposed by the physician dispositive and guaranteed by the legal apparatus. Although there is no official data, this paper concludes that in 2012 around 22 intersex persons were mutilated in Spain.
