The end of the primacy of the company collective agreement in salary matters
point of arrival or departure?
Abstract
Recent labour reform has ended the prevalence of the company agreement in salary respecto the sectoral agreement. In the rest of labour conditions (among others, distribution of working time or the professional classification system), the company’s collective agreement will continue to be applied preferentially. The effects of the aforementioned suppression in the pre-existing negotiation have recommended the incorporation of a transitory rule to facilitate its progressive and gradual application. All these questions as well as the effects of the conservation of the essential elements of the rule of concurrence of agreements established by art. 84 ET, are the subject of a detailed analysis in this study.
