Abstract

Based on sociopolitical, iusphilosophical and legal arguments; This paper argues that the application of the basic principles and rules of international humanitarian law (IHL) is necessary in urban violence, in which the application of force by the State police is necessary. Sociopolitical rationality is used to question the idea that urban violence is determined by the absence of rights; The philosophical approach addresses the relationship between the legitimacy of the State and the use of force; Finally, legal arguments are developed around IHL.
